WorkPay maintains high standards for the protection of privacy over the Internet. The purpose of this statement is to explain the types of information WorkPay obtains about visitors to our websites.

The only information WorkPay obtains about individual visitors to our websites is information supplied voluntarily by the visitor. This means that the visitor can visit our websites without telling us who they are or revealing any information about themselves –we DO NOT track where you go on our sites, so you never receive unsolicited emails from us.

You can choose to provide individually-identifiable information to WorkPay in a number of ways through our website – by joining our demo/trial product from us or request for a particular service, sending us an email, registering to receive newsletters or website update information.

When visitors supply information about themselves for a specific purpose, WorkPay uses this information for that purpose (such as to provide the information that the visitor has requested). In addition, when visitors use our websites for additional information of our products, or to request some information about our services, we may use the individually-identifiable information as we would use the same information obtained off-line.

If you have voluntarily provided personally identifiable information, we may, from time to time, send you mail or e-mail regarding products and services. If you do not want to receive such offers and mailings, you can easily unsubscribe the service by clicking the same in the e-zine/e-mail.

We do not sell or disclose individually identifiable information obtained on-line about our visitors to anyone outside of WorkPay unless law requires it, or disclosure is necessary to protect the safety of customers, employees or property.

Internally, we will restrict access to your personally identifiable information to employees who need access to the information in order to do their jobs. These employees are limited in number, and are committed to our privacy policies.

Some of WorkPay web pages may use “cookies” to improve our level of service to visitors. Cookies are lines of text that are transmitted to your web browser when you click on a site. Your browser stores the information on your hard drive and when you return to that site later, the cookie is transmitted back to the server that originally sent it to you. Cookies provide a way for a server to recall a previous request or previous registration, or to keep track of a transaction as it progresses, so that information does not have to be repeated.

To be notified when you are about to receive a cookie you can configure your browser to alert you when a site is attempting to send you a cookie and at that time you will have the option of refusing the cookie. This includes, among other things, using industry standard techniques such as firewalls, encryption, intrusion detection and site monitoring. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personally identifiable information, we cannot ensure or warrant the security of any information you transmit to us or receive from us. This is especially true for information you transmit to us via e-mail. We have no way of protecting that information until it reaches us. Once we receive your transmission, we make our best effort to ensure its security on our servers.

WorkPay is committed to safeguarding its customer privacy on all its webpages in its site www.myworkpay.com. We require our employees to protect the privacy of information about our customers and expect our partners and suppliers to do so as well. You can feel confident that your individually-identifiable information will be protected when you access our webpages over the Internet. We employ security measures to safeguard your transactions with us.

WorkPay website may contain links to other sites. We are not responsible for the content or the privacy practices employed by other sites.

To improve the services it can offer you, WorkPay may opt to expand its capabilities for obtaining information about users in the future. We will update our privacy statement continually to ensure that you are aware of developments in this area.

WorkPay has adopted Privacy Principles that state our commitment and define our policy on safeguarding customer privacy in all of our businesses.

Terms and Conditions of Use

Please read this Agreement carefully before accessing or using the Service.

By accessing or using the Service, you agree to be bound by the terms and conditions set forth below. If you do not wish to be bound by these terms and conditions, you may not access or use the Service and/or the Site. Workpay Limited may modify this Agreement at any time, and such modifications shall be effective immediately upon posting of the modified Agreement. You agree to review the Agreement periodically to be aware of such modifications and your continued access or use of the Service and/or the Site shall be deemed your conclusive acceptance of the modified Agreement. Seven (7)days prior notice will be given to you where a substantial change is to be made.

Introduction

Workpay offers a solution to employee management with Time Tracking, Human Resource Management (HRM), cloud-based Payroll processing with salary payments to employees’ bank accounts or mobile wallets. Workpay payroll works for any company, whether single entity or a multinational organization. 

Definitions 

“User” refers to the person who accesses and uses the Services.

“You” or “Your” means the company, employee or other legal entity for which you accept this Agreement, and Affiliates of that company or entity.

“We,” “Us” or “Our” means our company you are contracting with

Agreement 

These terms and conditions of use apply to both our registered users hereby the “Service Users” and unregistered users hereby the “Visitors”. By, registering, accessing, logging in, using our services (our website, including related mobile apps, web services, outsource services, or any content or information provided as part of these services, together, the“Workpay Service”, “Service” or “Services”) or similar, you agree and are entering into a legally binding agreement with our company. Your agreement with us includes these Terms and Conditions of Use (“Terms”) and our Privacy Policy.

Your License to Workpay

Any information held by us remains your exclusive property. However, we are provided a license to your data for the sole and exclusive purpose of providing the Services including a sub-licensable right to use, store, record, transmit, maintain, modify, process and display the data. The same is limited to the extent necessary in provisioning the Services. Commencement of the license shall be from the first date of being bound by this agreement until the agreement is terminated. Our privacy policy shall be applicable in handling any such provided data and information.

Prohibited Use of Our Services

By agreeing to use our services, you are thereafter responsible for all activities conducted under your user logins and for your users’ compliance with this Agreement. You agree to only use our Service solely for its internal business purposes, in compliance with applicable law, and shall not:

●       Allow use of the service by third parties including but not limited to reselling, sublicensing, leasing;

●       Misuse the service by sending or storing infringing or unlawful material including malicious code;

●       In any manner interfere with the service through attempts to gain unauthorized access, disrupt the integrity or performance of the Service or the data contained therein;

●       Modify, copy or create derivative works based on the Service;

●       Examine the composition of our service to make a duplicate or rather reverse engineer the Service;

●       Create a competitive product through access to the Service

●       Attempt to or use the Service or permit it to be used, for purposes of product evaluation, benchmarking or other comparative analysis intended for publication without our prior written consent;

●       Allow any access or use of our service by a competitor

Security

The registered user is ultimately responsible for administering and safeguarding any passwords created to control access to its account.

Termination

Termination of this agreement shall be through a notice inwriting by either you or us. You acknowledge and agree that we also reserve the right to restrict, suspend, or deny you access to all or part of the Service, or terminate your account, without notice, if we believe that you may be in breach of this Agreement or law or have engaged in any conduct which Workpay in its own discretion believes to amount to a misuse of the Service(s). On notice of termination you will have 30 days to download or export your data using one of many mechanisms such as reports, web services and business intelligence tools. After that 30-day period, we will have no obligation to maintain or provide your data, and will thereafter delete or destroy all copies of your data in our systems or otherwise in our possession or control, unless legally prohibited.

Ads on our service

We have the right to serve ads on any of our Services without compensation to you or others.

Consideration

You agree to pay us the applicable fees. Failure to pay these fees may result in the termination of your subscription.

Notifications and Communication  

Communication between you and us may be through notices to you by either a banner notice on the Service, or an email sent to an address you provided, or through other means including mobile number, telephone, or mail. You agree to keep your contact information up to date. You are able to indicate on your profile that you do not wish to receive email notices specifically.

Availability of the Service

It is our discretion to change, suspend or end any Service, or change and modify prices prospectively. Workpay uses commercially reasonable efforts to make its Services available throughout. For any planned downtime, we shall where reasonable give at least 10 hours’ notice. We do not howeverguarantee availability of the service where the unavailability is caused by circumstances beyond our reasonable control, including, an act of God, act of government, flood, fire, earthquake, civil unrest, act of terror, strike or other labour problem (other than one involving our employees), Internet service provider failure or delay, or denial of service attack.

Limitation of Liability and Indemnity

You will have no claim against us or any of our employees, or contractors in the event of any loss or damage sustained by you or any of you members, employees, sub-contractors or agents and which results directly or indirectly from this agreement. You hereby indemnify us, and hold us harmless against any and all claims, liabilities, losses, fines, damages, expenses, andlegal fees on an attorney, which you may sustain or incur by reason of any actor omission of you or any of your members, employees, sub-contractors or agents directly or indirectly in consequence of the services provided in terms of this agreement. We make no representation or warranty, either express or implied, in connection with the Service or the Services that may be provided by third party participants as part of, or otherwise in connection with, the Service.

Severability

If any of these Terms and Conditions of Use shall be deemed invalid, void, or for any reason unenforceable, that term shall be deemed severable and shall not affect the validity and enforceability of any remaining term or provision of these Terms and Conditions of Use.

Governing Law

This Agreement shall be treated as though it were executed and performed in Kenya and shall be governed by and construed in accordance with the laws of Kenya
